Letter to Klein in Response to APOG Demands

Hello,  A fellow owner, Richard Carson, has given us permission to reprint his letter to Klein in response to the demands of the APOG and Ed Wilson. Please read... Dear Simona: Thank you very much for forwarding the written proposals which have been sent to you by the Anchor Point Owners Group (APOG) represented by the law firm Lawson Lundell LLP.   Wendy and I are deeply concerned about the intent and implications of the proposals in these documents and we emphasize that under no circumstances will we agree to the recognition of a "Steering Committee" that may purport to make decisions or provide "oversight" pertaining to the sale of our property at Anchor Point 3.   We will retain our full authority to make any decisions about the sale, disposition or management of our private property as well as our portion of limited common property and common property within AP3. Further, we have sought our own legal counsel in relation to the listing agreement

APOG Demands to Klein Group

Klein Group now has a copy of the proposed listing agreement drafted by Ed Wilson at the direction of the APOG Steering Committee. It is available to all owners from their office, I have looked at it. I am afraid that rather than moving the process forward, it is designed to encourage failure and further conflict. For those of you (and your neighbors) that contributed to the APOG with the idea that their Steering Committee would be securing representation for you, that does not quite seem to be the case. Members of the Steering Committee have clearly given instructions to Ed Wilson on the drafting, and the document certainly reflects their interests. However, their interests are not the same as those of other owners, whether they be resident owners, investor owners or commercial owners. There are a few points of clarification and confirmation that I doubt Klein Group will have a problem with and can be incorporated into the existing Listing Agreement.

Rebuttal to APOG

APOG Steering Committee distributed a document to some, but not all, owners putting forth several arguments against signing Klein Group's Listing Agreement.  I am not sure if there is more than one page to their document but the page I was given by another owner has 7 arguments against the Listing Agreement. I am not sure what the end game is for the owners who are part of the APOG Steering Committee, but those within and outside of the APOG “collective” should understand that these arguments are fundamentally false. Perhaps it will be clarified when the amendments they wish to make to the Linsting Agreement are disclosed. Maybe those owners don't wish to sell or maybe they think a transaction like this can be accomplished without professional realtors truly committed to working on it. Most everyone, I believe is familiar with Klein Group's presentation. The update given at the Tower 1 meeting (held in Tower 3 lounge last week) is that there are 128 units signed in the AP development with the bulk of them in AP3, the June 15 date for discounted commission is coming up quickly, and, since the original presentation by Klein Group, the price per buildable foot in the downtown core has risen by about 3%. Klein Group now has just over 25% of the units signed to Listing Agreements. He has also received inquiries from additional qualified potential purchasers of the site who are aware that there may be an assembly in process. However, some serious antagonism arose between owners. That was the reason for the earlier posting requesting that people in APAC remember that other owners are not enemies and that avoiding harsh words is important to maintain a warm atmosphere in the buildings, whether or not the assembly is successful. Will I Have to Move Once the Sale is Complete?

Each owner will have the option to negotiate a discounted rent-back period so they can stay in their unit after the closing whether it is for as little as a month or as long as a year.
